Spousal Support and Alimony

Lexington, South Carolina: Alimony and Spousal Support

Courts sometimes use the term "spousal support" to refer to what has traditionally been called "alimony" and "palimony." When a marriage ends, it may be possible for one spouse to receive an award of spousal support. The amount and duration of spousal support depends on many different factors.

Unlike child support, there are several different types of alimony awards under South Carolina law.

Factors Considered by the Court in Making a Spousal Support Award

Unlike child support, which is determined based on a fairly strict mathematical calculation, spousal support has few hard and fast rules. The court will consider several different factors when deciding whether to award spousal support, including:

  • The length of the marriage
  • The spouses' standard of living during the marriage
  • The parties' agreement regarding property division
  • The amount, if any, of child support
  • Each spouse's level of education and work history
  • The party at fault for the dissolution of the marriage

Assistance from an experienced and dedicated attorney may be necessary to make sure that your rights are fully protected in a dispute over alimony or spousal support payments.
